                COVID-19 Q&A  -  4/17/2020

                Currently, parents are asking:

                1.  Does the pandemic mean that parenting time is suspended until it is over?

                No, under Michigan law, parenting time and joint custody orders remain in effect and should be honored.


                2.  If parents agree that parenting time should be suspended, does that mean that child support stops until parenting time starts up again?

                No, support must continue.  If support payments are made electronically, the parent paying cannot instruct his or her employer or financial institution to stop forwarding payments to the primary custodial parent.


                3. What should I do if my spouse is physically or emotionally abusive to me and my children?

                This medical emergency will end.  In the meantime while you are sharing a home with your spouse, STAY CALM.  Do not provoke the situation.  Contact the various local hotlines for advice.  If you are in immediate danger, call 911.  When the pandemic ends, and it will, you may decide to seek legal counsel to discuss your options.
